Terms & Conditions

1. Scope

All orders and deliveries are subject exclusively to the following General Terms and Conditions of Sale ("GTC"). Any conflicting or deviating terms and conditions of the customer are not recognized unless we have expressly agreed to them in writing in a specific case.

2. Contracting parties, formation of the contract

The contract is concluded with Doubledeck.

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog.

The customer can initially place our products in the shopping cart without obligation and correct their entries at any time before submitting their binding order by using the correction tools provided and explained in the ordering process. By ordering the desired goods by submitting the information to be completed in full in the order form, the customer submits a binding offer to conclude a purchase agreement with us. The customer is bound to their order for two days starting from the date of submission.

We will confirm receipt of the customer's order immediately by email ("order confirmation"). Unless expressly stated otherwise, this order confirmation does not constitute acceptance of the offer by us, but merely serves to inform the customer that we have received their order.

The point at which the contract with us comes into effect depends on the payment method chosen by the customer:

2.1 Klarna

A purchase agreement with us is concluded when we confirm the customer's order within 2 days by means of a further communication (e.g. letter, fax or e-mail).

2.2 Credit card

A purchase agreement with us is concluded when we request the customer's credit card company to initiate the payment transaction by submitting their credit card details.

2.3 PayPal

A purchase agreement with us is concluded when we request PayPal to initiate the payment transaction after the customer has confirmed the payment instruction to PayPal.

3. Contract language, contract text storage

The language available for concluding the contract is German.

We do not save the contract text.

4. Right of withdrawal

Consumers have a fourteen-day right of withdrawal.

4.1 Right of withdrawal in the case of a purchase contract

Cancellation policy

Consumers have a fourteen-day right of withdrawal.

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last goods.

To exercise your right of withdrawal, you must inform us

To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of the revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the cheapest standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

For this refund, we will use the same payment method you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods. For goods that, due to their nature, cannot normally be returned by post, these costs are estimated at a maximum of approximately EUR 35.00. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

5.1 Consumers may, in addition to and independently of their statutory right of withdrawal, return the goods within the period from the 15th to the 21st day after receipt by sending them back to the supplier we commissioned with the delivery of the goods. This is conditional upon a statutory right of withdrawal existing for the respective items (see section 4.5 of these Terms and Conditions) and the items being in unused and undamaged condition.

5.2 The return of goods to our supplier is at the customer's expense and risk. We will inform the customer of the supplier's name and address no later than upon delivery of the goods. The customer can use our online return service for returns.

5.3 If the customer exercises their right of return in accordance with section 5.1 of these terms and conditions, we will refund the purchase price already paid for the returned goods. Shipping costs paid by the customer will not be refunded.

5.4 The foregoing provisions do not affect the customer's statutory rights, in particular his statutory right of withdrawal pursuant to section 4 of these Terms and Conditions and any warranty claims.

The purchase price and any applicable shipping costs are due upon conclusion of the contract.

The following payment methods are generally available in our shop.

8. Retention of Title

Ownership of the goods we deliver only passes to the customer upon full payment of all claims arising from the purchase agreement.

The following also applies to businesses:

We retain title to the goods until all claims arising from the ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you hereby assign to us in advance all claims arising from this resale – irrespective of whether the goods subject to retention of title are combined or mixed with other goods – up to the amount of the invoice, and we accept this assignment. You remain authorized to collect the claims; however, we may also collect the claims ourselves if you fail to meet your payment obligations.

9. On account

For entrepreneurs, the following applies: The customer can only offset if their counterclaim arises from the same contractual relationship or is in a reciprocal relationship with our main claim, is not disputed by us, or has been legally established.

10. Warranty and Guarantees

For consumers: The statutory provisions apply to claims due to defects in the delivered goods.

For businesses, the following also applies: the limitation period for claims based on defects is one year from the transfer of risk; the statutory limitation periods for the right of recourse under Section 478 of the German Civil Code (BGB) remain unaffected. Only our own specifications and the manufacturer's product descriptions that have been incorporated into the contract constitute an agreement regarding the quality of the goods; we assume no liability for public statements made by the manufacturer or other advertising claims. If the delivered goods are defective, we will, at our discretion, initially provide a remedy to businesses by either repairing the defect or delivering a replacement.

The foregoing limitations and reductions of time limits do not apply to claims based on damages caused by us, our legal representatives or agents:

– in case of injury to life, body or health

– in the case of intentional or grossly negligent breach of duty as well as fraudulent intent

– in the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations)

– within the scope of a guarantee promise, insofar as agreed, and insofar as the scope of application of the Product Liability Act is opened.

Information on any applicable additional warranties and their exact terms can be found with the product and on special information pages in the online shop.

11. Liability

We are always liable without limitation for claims arising from damages caused by us, our legal representatives or agents.

– in case of injury to life, body or health,

– in the case of intentional or grossly negligent breach of duty,

– in the case of warranty promises, if agreed, or

– insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on the part of us, our legal representatives or vicarious agents, our liability is limited to the amount of the foreseeable damage that typically arises at the time of conclusion of the contract.

Furthermore, claims for damages are excluded.

12. Data Usage

The privacy policy can be found in the footer below under the heading 'Privacy'.

13. Jurisdiction and applicable law

For merchants, legal entities under public law or special funds under public law, the following applies: The place of jurisdiction for all disputes arising from this contract is our registered office.

For businesses: German law applies. The United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (CISG) does not apply.

14. Consumer Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr/.

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
